TERMS
AND CONDITIONS
These are the terms that Serpent trade
by.
In these terms
and conditions of trading. The ‘Client’ means
the persons(s), company or organisation to whom
the services of First Aid 1st are provided.
The ‘Student’ means the individual nominated
by the Client to attend a Serpent Training course
as a delegate. ‘Notice’ means verbal; by way
of telephoning followed with written; by way
of Royal Mail, email or fax. ‘HSE’ means the
Health and Safety Executive.
1. PRICES
All prices for First Aid 1st are published and
regularly updated on its website. Any discount(s)
must be negotiated between the Client and First
Aid 1st at the time of booking a course when
gaining a quote. All quotes relating to First
Aid 1st, including any discount(s) are valid
for 14 days from quotation date, whereupon the
price will return to its original published
price.
2. PAYMENT
All services are payable by the Client within
7 days from the invoice date. Any payment made
prior to this will be honoured and will be subject
to the relevant cancellation clause herewith.
3. CANCELLATION
First Aid 1st reserves the right to cancel or
postpone any pre-advertised course. Where this
becomes necessary, as much notice as possible
will be given and the Client will be offered
a choice, with due consultation, of an alternative
date to commence or complete the course as appropriate.
If pre-paid then either: (a) a full refund if
the course has not yet commenced and (b) a proportionate
refund if the course has commenced but not yet
finished*. In the circumstances where the Client
requests cancellation of an already reserved
place or places on a course, no fee will be
payable, provided that not less than 21 days
notice is given to First Aid 1st prior to the
course commencement; if less than 21 days notice
is given, First Aid 1stt reserves the right
to make an appropriate charge for administrative
and other expenses as follows:-

14 to 21 days = 25%
7 to 14 days = 50%
Less than 7 = 100%
In exceptional
circumstances within the 21 days time frame,
and at the discretion of Serpent, a reserved
place or places on a course may be postponed
rather than cancelled. In these circumstances
the Client must consider transferring the student
to a similar First Aid 1st course to be run
at a later date. Transfer of students to another
similar course will be confirmed in writing
to the Client and cancellation fees will be
waived. Postponement of a reserved place or
places on a course can only take place on one
single occasion. Further postponement of an
already postponed place or places will be treated
as a cancellation and will be subject to a cancellation
fee of 100% regardless of the amount of notice
which is given by the Client. Exceptional circumstances
mean sudden illness, injury or compassionate
grounds.
4. FAILURE
TO ATTEND
Should any student fail to attend a course or
part of a course on which a place has been reserved;
fees in respect of that student will be payable
in full, however: (a) if the course on which
a place has been reserved has not yet commenced,
a substitute student may be nominated (b) if
the course on which a place has been reserved
has already commenced, but for exceptional circumstances
the student has not been able to complete the
course, an alternative date will be offered
to enable the student to complete the remaining
part of the course.
5. SUITABILITY
The Client is responsible for ensuring that
any student selected to undertake a First Aid
1st training course conforms to any applicable
pre-requisite as laid down by First Aid 1st;
failure to comply with this may result in the
student being withdrawn from the course or the
issue of their certificate of attendance / qualifications
being held back until such times as the requirements
are met. Any course held at a Clients’ premises
should comply with the HSE guidelines thus having
safe access and means of escape; adequate: toilet
facilities, heating, lighting, ventilation and
suitable floor space for practical sessions.
6. DISCLAIMER
First Aid 1st shall not be held liable for any
loss, damage, expense, injury or delay of any
kind to the Client or Student of the Client
or any third party by any act, default or omission
howsoever caused, except insofar as such liability
cannot be excluded by law.
7. ALTERATION
First Aid 1st reserves the right to amend these
terms and conditions without prior notification.
These terms and conditions shall be governed
by English law and any alterations, modifications
or extensions affecting the above clauses shall
not be valid unless agreed by First Aid 1st
and acknowledged in writing.
